Terms and Conditions
Your contract is with the owner of the property.
These terms and conditions make it clear the expectations and responsibilities of both the owner (or agent acting on behalf
of the owner) and the guest or booker. If you have any questions, please do not hesitate to ask.
Glossary
Property
- means the property offered or any property rented by the Owner including any property offered or rented in conjunction with
the main property (e.g. Beach hut) as part of a holiday package.
The agent - means the person who may take bookings or manage the property on behalf of the Owner.
Guest/Guests(s)/Party - means the person or people renting and staying at the property.
Guests include any individual sleeping at the property for one or more nights during your stay. Names are required for
reason of health and safety (fire).
Occupancy level/headcount
- the number of guests minus any infants. Infants are children aged two or under who are sleeping in a travel
cot and therefore do not require a bed space.
Booker - means the individual(s) or organisation representative
making the booking on behalf of the Guest(s). This may include an individual who is booking on behalf of a party but who is
not be staying at the property. They are responsible for the property as if they were staying at the property. This person
must be over 18.
Principal Guest/Guests(s) – means the
person who will be staying at the property and will be a point of contact for the owner or agent during the stay. This
person is usually the Booker. Where the Booker is not going to be staying at the property another of the Guests should
be identified as a second point of contact for the owner or agent for the duration of the stay. This person must be over 18.
I or we or us - means the Owner of the Property.
You or your - means the Booker and Guest(s)
The stay/your stay - means the rental period.
Total Rental Value - means the
total price at which you agree to rent the Property.
Holding deposit - means the deposit you pay
to reserve the property. This is non-returnable. This forms part of the Total Rental Value. See below for more information.
Returnable security deposit - means the deposit paid which is returnable after your holiday assuming there is no loss
or damage to the property or contents and that there are no other monies that are owned by the guest or booker to the owner
or agent.
Amount payable - This is a combination of the Total Rental Value, Security Deposit and
any fees or charges as a result of payment option chosen by the guest/guests or booker.
Rental
The rental of the Property is subject to availability. Bookings may be made
by the owner or their agent. The booking has not been made until confirmed in writing by the owner or agent, this includes
payments made through the online booking method via our website. Bookings confirmed in writing will stand only if payments
required and agreed are paid on time and documentation is completed and returned.
The rental agreement is for the period of the agreed stay as indicated in the booking form and/or
holiday contract only. The contract is with the owner. The owner agrees to let the property under license to the guest(s)
giving them permission to occupy, with the guest(s) agreeing to give full vacant possession on or before the agreed departure
date at or before the agreed departure time.
The license to
occupy the premises expires on the agreed date of departure. All keys must be surrendered. All rights of access to the property
are withdrawn after that agreed departure date and time.
The guests have a duty to provide correct
information to the owner or agent. Any information provided subsequently found to be wrong or misleading could result in the
cancellation of the holiday by the owner or agent. The Booker will be liable for payment of the holiday in accordance with
the terms and conditions and this may mean that the holding deposit or the total rental value is retained by the owner or
agent and that any other costs incurred become payable.
The owner or agent reserves the right to cancel the holiday
without notice by making a full refund to the guest or booker, at any time.
Provided in the cost of your holiday:
Reasonable use of all items on the property inventory
and any parking spaces.
All utility costs: gas, electricity and water.
Beds and linen are provided in line with the occupancy levels
of the booking. One bed space is provided for each adult or child (not infant). Where there is a flexible sleeping
configuration available, this will be agreed between the owner or agent and guest or booker prior to the arrival of the guest(s).
Additional beds and upgrades in bed size, above the minimum requirements for the size of the party, may be available
at an additional charge. Please note that the owner will provide a complimentary upgrade in bed size if a smaller
bed is not available.
Not provided:
Only the items on the inventory and subsequently agreed in correspondence
with the booker will be made available.
No bedding linen
is available for any travel cot supplied by the owner or for any additional travel cot the guests choose to bring.
Please note that bedrooms not being used as indicated by the agreed sleeping configuration may be locked.
Where appropriate, a sleeping configuration will be agreed between the owner or agent and guest or booker prior to
arrival of the guest(s). This will indicate what bedrooms are being set up for use by the guest(s) and in what configuration.
Please note that bedrooms that are not being used may be locked.
Arrival and departure
In order that the Property can be thoroughly
cleaned and garden/yard maintained between lets, your letting commences at 3pm on arrival day and terminate at 10:30 on departure
day, unless by written prior arrangement.
Pricing
Charges take in to consideration the date of your holiday, length of
stay and occupancy levels. Babies (sleeping in travel cot) do not count towards the occupancy levels. Standard
rental costs and any additional payments and costs are clearly displayed on our website.
Holding Deposit
A holding deposit is payable.
This will hold the property for you for the agreed dates if you book more than 60 days in advance of the start of your holiday
or if for any other reason the Total Rental Value is not payable immediately. This is not refundable.
If the holiday is cancelled prior to 60 days before the holiday date, the holding deposit
is not refundable; however, no further monies will be required.
If
you choose to pay the full amount of your holiday early but then cancel your holiday prior to he 60 days before the start
of your holiday, only the holding deposit will be retained, the balance refunded.
If the holiday is cancelled within 60 days of the start of the holiday, the total rental value is not
refundable and will be required if not already received. We will, however, endeavour to re-let the property and refund the
cost of the holiday less the holding deposit and any costs.
We
strongly advise taking insurance to cover this eventuality to minimise the risk of any financial loss to you if you are unable
to take your holiday as planned, perhaps through illness.
Payment
There are various payment options available. The owner or agent, for some payment options, will make
charges; these will be made clear to the Booker in advance where they are known.
Where a fee is
levied, such as for the use of credit cards, this must be included in the monies paid to the owner or agent. If this is not
included and is not paid by the end of the holiday, the owner or agent will deduct the amount outstanding from the returnable
security deposit.
Any charges made by the bank of the guest or booker must be paid by the guest or
booker. These fees or charges cannot be anticipated by the owner or agent and can therefore not be indicated in advance. It
is the responsibility of the guest or booker to ensure they know what fees or charges apply. It is the responsibility of the
guest or booker to include provision for these fees or charges in the payment to the owner or agent if the amount paid to
the owner or agent is reduced due to these charges. If these charges have not been settled prior to the end of the holiday
and therefore money is still outstanding, the owner or agent will deduct the amount outstanding from the returnable security
deposit.
Payments from outside the UK may be subject to currency conversion rates. Where the amount
received in sterling affects the amount received by the owner or agent and money is outstanding to the owner or agent, the
guest or booker must pay any balance outstanding. If it is not paid by the end of the holiday, the amount outstanding may
be deducted from the returnable security deposit.
Where a payment to the owner or agent is affected
by currency conversion rates so that more money is received by the owner or agent than is required for payment of the holiday,
the amount in excess of the monies required for payment of the holiday will then be deemed to form part of the returnable
security deposit. As per the terms and conditions, the amount held as a security deposit is returned at the end of the holiday
assuming no damage or loss to the property or any fees or charges remain outstanding.
Booker and Guest responsibilities
You agree to take good care of the Property, to leave it
clean and tidy and replace any breakages.
We reserve the right to make a charge for damaged or missing items from the inventory
or for other costs incurred such as extra cleaning costs above and beyond which can be classed as reasonable wear and tear
from enjoyment of the Property. This amount will be taken from the returnable security deposit in the first instance; payment
for the amount over and above the difference between the cost and the amount of the security deposit may be required to be
paid to the owner or agent.
Please note that it is a legal
requirement that there should be no smoking within the property
Occupancy
levels
You agree that the maximum number of people to use the Property will be the number you specified to us. Additional
charges will be made if it is believed more people than the maximum number specified by you and agreed by us slept at the
property during your stay. We reserve the right to deduct these additional costs from the returnable security deposit in the
first instance.
Access
You will expect to have quiet enjoyment of the property for the length of your stay.
We, the agent or other representative shall be allowed access to the property at any
reasonable time for essential maintenance. Whenever possible this will be by prior arrangement.
Pets and other animals
Well-behaved
pets of guest(s) are welcome at the property but must not be brought without prior permission. When permission is given, the
following conditions apply:
Pets should not be allowed on the beds or other furniture
Pets should not be
left unsupervised in the property
Pets should not be unduly noisy as to cause offense to neighbours
If any additional
cleaning is necessary, a charge will be made. This may be deducted from the returnable security deposit.
No animals,
other than the guest(s) pets under the conditions indicated above, are allowed in the property.
Disclaimer
No liability is accepted in respect
of injury, loss or damage to you, guests(s), pets, visitors to the property or personal belongings of anyone staying at the
property or visiting.
We cannot accept responsibility
or pay any compensation where the performance or prompt performance of our contact with you is prevented or affected by reason
of circumstances that amount to "force majeure". This includes any event which we could not, even with all due care,
foresee or avoid, for example the destruction or damage of your accommodation through fire, flood, explosion, storm or other
weather damage, break-in, criminal damage or any similar event beyond our control.
Whilst every effort is made to ensure the accuracy of information given, either orally or in writing,
all information is given in good faith, but no such information will be deemed to be a representation or warranty and we shall
have no liability therefore and neither will it create any liability on our part.
Any shortcomings
You must notify any shortcomings
with your accommodation to us immediately so that remedial action, if appropriate, can be taken. No such matters can be dealt
with after completion of your stay.
Holiday insurance
As with any holiday, you are strongly advised to take personal holiday insurance. There are many insurers offering holiday
cover to protect your money should you need to cancel your holiday for reasons beyond your control.
